FORT WAYNE, Ind. (WOWO): One man has been charged with a felony after admitting to shooting a gun into the sky.

According to our partners in new at 21 Alive, shots were fired around 3:00 a.m., Friday morning from a vehicle on Clinton Street near Lima. An officer was sitting on Clinton Street when he saw shots being fired from the vehicle traveling south on Clinton.

The officer called in shots fired to dispatch and other police units on duty caught up with the vehicle and performed what they call a “felony stop.” According to police reports, several shell casings were found in the vehicle. The driver, identified as “Back” was taken into custody and the passenger, Brain Cremins, was also taken into custody. He told police the only thing he was guilty of was being drunk and having an open container. The passenger was issued a citation for consuming alcohol in a vehicle while it was moving and he was released.

The driver told police that he was shooting the gun out of the sunroof. He said he "wasn't shooting at anyone, just shooting at the sky". He was charged with reckless driving, criminal recklessness and because he had a prior conviction for possession of a handgun without a license, his charge was enhanced to a felony.
