In Vitro Firing Case to Move Forward

A lawsuit filed by a Fort Wayne Catholic school teacher will move forward.  Emily Herx was terminated from her position with St. Vincent de Paul School after it was discovered by school officials that she had undergone in vitro fertilization.  The Journal-Gazette says that a federal judge has allowed the suit against the local Catholic diocese to be heard.  At issue is the fact that Herx suffered from infertility, a condition protected by the Americans with Disabilities Act.  The diocese contends it acted on its religious beliefs and any law preventing that action would violate the church’s constitutional right to practice its religion freely.  A meeting between the two sides is scheduled for later this month to decide how to move forward.
