Lawsuit Against Diocese Settled

FORT WAYNE, Ind. (WOWO): A legal case between the Roman Catholic Diocese of Fort Wayne and South Bend and a former teacher is coming to an end.

According to court records, both the Diocese and Emily Herx, who sued them after being fired for undergoing in vitro fertilization treatments, which is against church teachings, have filed a joint motion to dismiss the case. A year ago, a jury awarded Herx $1.9-million, but that's since been reduced to just over $400,000.

Herx's attorney tells the Journal Gazette the case between the two parties has been settled.
