Wrongful death suit to move forward

FORT WAYNE, Ind. (WOWO): A wrongful death lawsuit against the City of Fort Wayne will be allowed to proceed.

A federal magistrate says the lawsuit filed by the estate of 33-year-old Lance Royal says while the five Fort Wayne police officers named in the suit are immune from wrongful death allegations, the city can be held liable.

The Journal Gazette reports that Royal died from a seizure, caused by a drug overdose, while he was chained to the floor near an interrogation desk in June 2015.

His widow says the city denied him medical care after he was arrested, but police say he refused medical care when he was taken into custody.
