KOKOMO, Ind. (AP): A Kokomo man has been ordered held on $1 million bail while awaiting a new trial after a federal court vacated his 2002 murder conviction.

The Kokomo Tribune reports Howard Superior Court Judge William Menges set the bail Friday. The U.S. Southern District Court of Indiana ruled in April that 33-year-old Torray Stitts received ineffective assistance from his attorney during his trial nearly 12 years ago and threw out his conviction.

He had been found guilty of shooting 28-year-old Kevin Hartson twice in the head in 2002.

Defense attorney Michael Ausbrook says the state's main witness, Ed Lawton of Kokomo, died in a Chicago shooting several years ago. A motion to exclude prior testimony of Lawton has been denied.

The trial is scheduled to begin Nov. 14.
