SOUTH BEND, Ind. (AP) – The American Civil Liberties Union of Indiana has filed a lawsuit on behalf of the South Bend Common Council president against the council over a social media policy approved earlier this month, alleging it is unconstitutional.
The lawsuit filed Monday in U.S. District Court in South Bend on behalf of Council President Oliver Davis contends the policy regulates and restricts what council members can put on their private social media sites. The lawsuit contends the policy violates council members' First Amendment rights.
The policy was passed after earlier this year some residents complained a council member had posted an explicit photo on Facebook in January. He was criticized later for sharing a tweet that made a disparaging remark about Republicans.
