INDIANAPOLIS (AP) _ Indiana will ask the U.S. Supreme Court to stay a 7th U.S. Circuit Court of Appeals' ruling that found the state's gay marriage ban unconstitutional.
Attorney General Greg Zoeller said Thursday that it seems clear the issue will have to be decided by the U.S. Supreme Court. Zoeller says his office will seek a stay while it appeals the decision.
Zoeller says he hopes the nation's highest court will decide the issue “sooner rather than later.''
The federal appeals court in Chicago on Thursday affirmed a federal judge's June 25 opinion striking down Indiana's ban on same-sex marriage. Judge Richard Young's ruling was stayed three days later.
The attorney general's office says that stay remains in effect.
