INDIANAPOLIS (AP) — Jurors have sided with Marsh Supermarkets in a lawsuit that alleged its former CEO used the company as his “personal checkbook” to fund expensive overseas vacations.

The Indianapolis Star reports that a federal jury decided late Friday that 75-year-old Don Marsh committed fraud and should pay the company $2.2 million.

The supermarket chain had accused Marsh of defrauding it of millions of dollars to finance extravagant trips and to buy expensive gifts for friends and family. Marsh has said the lawsuit was an effort to tarnish his reputation.

The company has about 100 stores in Indiana and Ohio. The lawsuit alleged that Don Marsh abused his authority as CEO “to facilitate his covert use of its coffers as his own personal checkbook.”
