Lake County Prosecutor Mulling Death Penalty in Darren Vann Case

CROWN POINT, Ind. (AP) _ A judge has rejected a request by a northwest Indiana prosecutor for a subpoena for military and school records of a man charged in the strangulation deaths of two women and suspected of killing five others.
 
The Times of Munster reports Lake County Prosecutor Bernard Carter told Judge Diane Boswell on Friday he wanted the records as his office considers whether to seek the death penalty against 43-year-old Darren Vann of Gary.
 
Defense attorney Teresa Hollandsworth argued the prosecutors shouldn't be granted the subpoena because the records aren't related to the charges against him. She also argued the request was premature because Vann doesn't yet face the death penalty.
 
Vann also waived his right to appear at future court proceedings unless the court indicates he is required to appear.
