FORT WAYNE, Ind. (WOWO): A hung jury isn’t stopping the Allen County Prosecutor’s Office.

The prosecutor’s office is going to retry Richard Niemeyer for a 1993 murder, according to our partners in news at 21Alive.

Neimeyer is accused of beating Kevin Weisenburger to death with a barbell inside Weisenburger’s apartment. DNA evidence connected Niemeyer to the scene of the crime, but a jury couldn’t come to a decision last week and the judge declared a mistrial.

The victim’s mother told 21Alive she doesn’t think Niemeyer did it.

His next court date is August 11th.
