PROVO, Utah (AP) — The man accused of killing conservative activist Charlie Kirk is headed to trial and could face the death penalty if convicted.
A Utah judge ruled Tuesday that prosecutors presented enough evidence to pursue an aggravated murder charge against 23-year-old Tyler Robinson.
Prosecutors allege Robinson shot Kirk once in the neck from a rooftop more than 400 feet away while Kirk was speaking to a crowd at Utah Valley University last September. They argued the shooting put other people nearby at risk.
Robinson’s attorneys argued prosecutors had not shown a high enough probability that others could have been killed and asked the judge to prevent the death penalty from being considered.
Robinson has pleaded not guilty.
Prosecutors also allege Robinson targeted Kirk because of his political views. They cited messages, DNA evidence and an inscription on a bullet as evidence of a political motive.
The judge’s ruling allows the aggravated murder case to move forward to trial.

Ya know, Charlie’s facts weren’t always spot on, but he was a very smart and influential debater.
I learned a lot listening to both he and his contenders. (especially Mr. Withers)
Since his death, though, that facet of YouTube has really been on the decline. I miss the civility of the engagements, and the ability for everyone to express their view.
Now, it seems mortality has clutched the spirit away from those public and group debates.
I have always hated when people are made ‘examples’ of, .. but in this instance, i hope that Tyler is dealt with deservedly & harshly.
I don’t need him to be executed, though i’d rather not share a planet with him.
…and, i REALLY don’t need him back on the streets, in as little as 15 years from now, being treated as a hero!
He’s sure to be seated, as an important figurehead, on The View’s 45th Season. 🙄
..prolly right along-side Crooks, Routh and Allen.
