State Court of Appeals Rules on Gender Identity Same-Sex Marriage Case

INDIANAPOLIS (WOWO): The state Court of Appeals has ruled that Indiana's law banning same-sex marriage cannot be used to invalidate a marriage if one spouse later changes his or her gender identity. David Paul Summers married Angela Summers in 1999. But he legally changed his name to Melanie Davis in 2005 and his birth certificate was later changed to “female.” Davis filed for divorce last year and the couple reached a provisional order granting Davis custody of their child. But a Monroe County judge rejected the divorce petition, finding the marriage was invalidated when Davis' birth certificate was changed and the union consisted of two women. But now, the appeals court has overturned that decision insisting the marriage must be dissolved through traditional means.
