LAFAYETTE, Ind. (AP) _ A judge has ruled Tippecanoe County commissioners acted legally when they passed an ordinance blocking a proposed limestone quarry project along the Wabash River.
WLFI-TV and the Journal and Courier reported Monday the court ruled in favor of the county on all counts in the case brought against them by Nashville, Tennessee-based Rogers Group Inc. over a quarry planned near the town of Americus a few miles northeast of Lafayette.
The lawsuit alleged that the county commission didn't have power to pass an ordinance banning the quarry, that the county had violated Rogers Group's mineral rights by passing the ordinance, and that the county had taken land owned by the company for public use without just compensation.
A company spokesman says the company will comment later Monday on the ruling.
