INDIANAPOLIS (AP) _ The state won't have to pay any more damages from the 2011 deadly Indiana State Fair stage collapse under a decision by the state Supreme Court.
The justices voted 3-2 to not hear an appeal of a lower court decision upholding the state's $5 million liability cap in a case brought by a 13-year-old Jordyn Polet of Cincinnati, who was hurt in the collapse. The lawsuit argued the cap violates the Indiana Constitution and that she was treated differently than others who sued the state.
The collapse happened when high winds blew down rigging before a concert by the country duo Sugarland. Seven people were killed and more than 100 were injured.
Polet attorney Robert Peck says he's disappointed that she won't get her day in court.
