ANDERSON, Ind. (AP) _ A former central Indiana police officer is appealing his eight-year sentence for causing a crash that killed a man and injured his pregnant wife.
The Herald Bulletin reports (http://bit.ly/1N3ED8R ) 42-year-old James Foutch of Edgewood filed his notice of appeal on Sept. 30.
He was sentenced Sept. 17 after pleading guilty to reckless homicide and criminal recklessness in connection with the April 6, 2014, death of 23-year-old Jesse Sperry of Noblesville.
Authorities say Foutch was off duty and under the influence of an anti-anxiety drug and a painkiller when his SUV going more than 90 mph plowed into the rear of a car on Indiana 32 near Anderson. The crash killed Sperry and injured his 22-year-old wife, Rebecca Sperry, who gave birth that day to a daughter by emergency C-section.
