PERU, Ind. (AP) _ Prosecutors won't charge a northern Indiana man who they say shot and killed an intruder who attacked him with a baseball bat.
Miami County Prosecutor Bruce Embrey said Tuesday the shooting of 30-year-old Donny Sturgill of Peru was a justifiable homicide. He cited the “castle doctrine,'' which allows someone to use deadly force against an unlawful entry into one's home.
The Kokomo Tribune reported Andrew Baldwin of Denver shot Sturgill on Saturday night after Sturgill smashed a window and hit him with a baseball bat.
Baldwin told deputies Sturgill texted him saying he wanted $200 that Baldwin owed for a phone bill. Baldwin said he feared Sturgill, who had served a prison term for aggravated battery, and he borrowed a gun from an acquaintance after receiving the text.
