EVANSVILLE, Ind. (AP) _ The Indiana Supreme Court will consider arguments that Evansville’s smoking ban is illegal because of its exemption for the city’s riverboat casino.

The decision gives a group of Evansville taverns and private clubs a new chance after the state appeals court in February upheld the city ordinance.

The city ban took effect in April 2012 and prohibits smoking in all businesses other than the Tropicana Evansville casino. Opponents of the ban argue that its treats their businesses unfairly.

Opponents attorney Charlie Berger tells the Evansville Courier & Press that he believes the businesses could have a better chance to prevail before the Supreme Court.

The court hasn’t yet set a date to hear arguments.
