Court Rules Against Ex-con in Bike Wreck Suit

INDIANAPOLIS (AP) _ The Indiana Court of Appeals says a man whose face was disfigured in a bicycle wreck that happened while he was drunk can’t blame Indianapolis officials or a utility for the accident.

The judges ruled 3-0 Monday that Paul Komyatti Jr. was drunk and riding the wrong way on an Indianapolis street in 2010 when his bike hit a pothole, flinging him face-first onto the pavement.

Court records say Komyatti’s blood-alcohol level was substantially over the legal limit to drive when he left a bar on his bike.

Komyatti sued the city and Citizens Energy, saying they were responsible for the pothole.

Komyatti spent more than 25 years in prison for holding his father down while he was decapitated during a 1983 attack in Hammond.
