Ex-Elections Chief’s Request for New Trial Denied

NOBLESVILLE, Ind. (AP): A central Indiana judge has denied former Secretary of State Charlie White's request for a new voter fraud trial.

Hamilton County Superior Judge Daniel Pfleging, in a ruling dated Monday, rejected White's argument that his trial attorney, Carl Brizzi, had provided ineffective counsel. Pfleging wrote there was no evidence to show Brizzi should not enjoy a “strong presumption of competence” and that his trial strategy was “objectively reasonable.”

A message seeking comment was left Thursday at the office of White's appeal attorney Bryan Ciyou.

White was removed from office in February 2012. The charges stemmed from his use of his ex-wife's home in Fishers as his voting address.

Pfleging ordered White to begin serving his one-year home detention by January 10th.
