Judge dismisses 3 of 6 counts against former Lutheran CEO

WILLIAMSON COUNTY, Tenn. (WOWO): A Williamson County circuit court has dropped 3 of 6 counts against former Lutheran Health Network CEO Brian Bauer.

Trade and disparagement, unfair and deceptive business practices, and breach of duty of loyalty counts were all dismissed, according to the Journal Gazette.

Bauer was fired last June after a failed takeover bid to buy Lutheran Health Network from Community Health Systems.

CHS, which owns Lutheran Health Network, is suing Bauer for alleged breach of contract to lure competitor Indiana University Health to Fort Wayne. Bauer has a contract position with IU Health Fort Wayne.

The judge did rule the case would be held in Tennessee and not in Indiana.
