Legal Wrangling Leaves 2011 Noble County Death Case in Limbo

ALBION, Ind. (AP) — An unprecedented battle over where two Fort Wayne men should be tried in the death of a woman in 2011 could delay the case for a year and might not result in murder charges.

Thirty-two-year-old Victor Gonzalez and 35-year-old Andres Gonzalez are charged in the death of Erin Justin. Her body was pulled from a Noble County lake in July 2011.

Investigators said she had drugs in her system and a concrete block tied to her body to weigh it down.

But The Journal Gazette reports investigators still aren't sure whether her death was an accident or intentional or where she died.

Noble County prosecutors want to keep the case and are appealing a judge's order sending the case back to Allen County, where the crime reportedly occurred.
