SOUTH BEND, Ind. (AP) _ A man wanted on a charge of assisting a criminal in the shooting death of a 2-year-old South Bend boy has agreed to waive extradition so he can be returned to Indiana.
Twenty-three-year-old Xavier Primm of South Bend has been held by authorities in in Decatur, Illinois, since turning himself in on April 21. The St. Joseph County Prosecutor's Office says Primm waived the extradition proceedings Thursday.
He was the last of eight men sought in connection with a gunfight between gangs that police say led to a stray bullet striking John Swoveland Jr. outside a home on April 9.
The prosecutor's office said it won't announce when Primm will be returned to Indiana because of security concerns.
Two 19-year-old men have been charged with murder in the shooting.
