SOUTH BEND, Ind. (AP): A South Bend judge has accepted a third plea agreement for a teenager accused of bringing drugs to a party that two brothers attended before dying of overdoses.

Under the deal accepted Thursday, 19-year-old Kyle Treber will plead guilty to drug possession while prosecutors will drop three counts of dealing narcotics.

The South Bend Tribune reports the new agreement allows St. Joseph Superior Court Judge Jane Woodward Miller to hand down any sentence within the state guidelines of six months to 2 1/2 years. The previous deals she rejected capped Treber’s maximum sentence.

Treber allegedly brought the prescription painkiller oxycodone to a June 2015 party in Granger. Nineteen-year-old Nick Savage and 18-year-old Jack Savage were found dead the next day.

Miller hasn’t set a date for Treber’s sentencing.
