BMV spokesman Josh Gillespie said the local judge has denied the state's request to stay a ruling that ordered it to resume selling vanity plates. The BMV had suspended the plates' sales after Judge James Osborn found the BMV violated a police officer's freedom of speech when it revoked a license plate that read “OINK.” That broad ruling also found the BMV's rules for issuing the plates unconstitutional.
Gillespie said Wednesday that the bureau also has asked the Indiana Supreme Court for a stay. It did that the same day it notified the top court it will appeal Osborn's ruling.
