No Criminal Charges to be Filed in Allen County’s First Homicide of 2014

ALLEN COUNTY, Ind. (WOWO): Allen County Prosecutors will not file charges in the first homicide death of 2014.

A release sent by Allen County Prosecutor Karen Richards says the Office of the Allen County Prosecuting Attorney has finished its review of the investigation of the shooting that happened January 19th at the Dupont Bar and Grill on N. Clinton Street, which resulted in the death of 32-year-old Damian Miller II.

The investigation was done by the Allen County Sheriff's Department and showed that Miller attacked the security officer for the bar by hitting him in the head with a glass beer bottle, shattering the bottle, and injuring the employee. The Department says that in self defense, the employee shot Miller. Under state law, officials say a person is justified in using deadly force and doesn't have to retreat if the person reasonably believes that force is necessary to prevent serious bodily injury to the person.
