SOUTH BEND, Ind. (AP): The chairman of the Pokagon Band of Potawatomi Indians says the tribe doesn't need to negotiate a compact with Indiana for a planned South Bend casino because a new state law violates federal law.
Tribal Chairman John Warren said Wednesday that the law that went into effect last week limits how Gov. Mike Pence can negotiate with the tribe. He says it violates the federal Indian Gaming Regulatory Act by stipulating what the agreement must include.
University of North Dakota School of Law Dean Kathryn Rand doesn't see a significant problem with the state law. She's co-director of the Institute for the Study of Tribal Gaming Law and Policy and says she doesn't believe the state law is trying to replace federal requirements, but pose additional state requirements.
