FORT WAYNE, Ind. (WOWO): A New Haven man is facing a felony rape charge following an investigation into an alleged sexual assault that occurred late last year.
According to court documents, 37-year-old Andre Davis was formally charged Wednesday with one count of rape. The felony charge carries a potential prison sentence of up to 16 years if convicted.
Investigators say Davis was staying at an apartment shared by the alleged victim and another person when the incident occurred. Court records state the woman told police she refused Davis’ request to have sex. She later reported that Davis returned and allegedly assaulted her.
Authorities say the woman later provided police with text messages she claimed were exchanged with Davis after the incident. According to court documents, she confronted him about forcing her to have sex without her consent.
The victim also reported receiving medical treatment following the alleged assault. Investigators say she later identified Davis from a photo lineup.
Davis was charged following the investigation and court filing. The allegations remain accusations, and Davis is presumed innocent unless and until proven guilty in court.
