Your Legal Duties to Trick-or-Treaters

FORT WAYNE, Ind. (WOWO):  If you're preparing for Halloween this year, you might want to be concerned about more than just what kind of candy you'll be handing out to Trick-or-Treaters.

Before the holiday rolls around, think about preventing any potential lawsuits. For example, Lawyers.com Editor-in-Chief Larry Bodine says,

“If somebody falls down and chips a tooth, that’s going to be covered by homeowners insurance, but if somebody falls down and loses an arm, or ya know hits something sharp and they can’t walk anymore and they have a really serious injury, that’s a case that’s going to court.

We then asked him for some suggestions for anyone passing out treats.

They’re (trick-or-treaters) your guests, turn on the lights, you don’t have to go overboard, but do what a reasonable person would do to make your property safe, you have a legal duty to make your property safe for them.”
