Ohio Supreme Court Hears Challenge to State Ban on Local Flavored Tobacco Restrictions

COLUMBUS, Ohio (WOWO): The Ohio Supreme Court heard arguments Tuesday in a closely watched case that could determine whether cities have the authority to ban flavored tobacco and nicotine products.

The dispute centers on a provision included in Ohio’s 2023 state budget that prohibits local governments from enacting their own restrictions on the sale of tobacco and alternative nicotine products. The measure became law after lawmakers overrode a gubernatorial veto.

Attorneys representing Columbus and more than 20 other Ohio cities argued that the state exceeded its authority by preventing local governments from adopting their own public health regulations.

Supporters of the cities’ position contend municipalities should be allowed to enact restrictions they believe are necessary to protect residents, particularly young people, from flavored tobacco and nicotine products.

The state, meanwhile, argues that tobacco regulation should be governed by a uniform statewide standard rather than a patchwork of local ordinances.

Legal observers say the case could have implications far beyond tobacco policy. A ruling could help define the balance of power between state and local governments on a range of issues, including zoning, firearms regulations and other matters where state lawmakers have sought to limit local authority.

The Ohio Supreme Court did not immediately issue a ruling. A decision is expected at a later date.
