Insanity Defense Sought in 73-year-old Man’s Death

NOBLESVILLE, Ind. (AP) – The attorney is seeking to use an insanity defense for a teenager charged with fatally attacking a 73-year-old suburban Indianapolis man.

The attorney for 17-year-old Maxwell Winkler of Fishers filed a notice of insanity or mental disease defense Friday in a Hamilton County court. The Indianapolis Star reports a judge will appoint doctors to evaluate Winkler.

Winkler faces a murder charge in the Nov. 1 slaying of Henry Kim. Authorities say Kim was shot three times with his throat cut in a subdivision near Geist Reservoir where both he and Winkler lived. Police say Kim was taking an evening walk when he was attacked.

Prosecutors say investigators seized a planning note from Winkler with steps that included “select prey” and “enjoy kill.”
